TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of the J Marquel Watch Company website, online store, products, services, and related offerings.

J Marquel Watch Company (“J Marquel,” “Company,” “we,” “us,” or “our”) is a luxury watch company offering automatic timepieces, interchangeable straps, and related products.

By accessing our website, creating an account, placing an order, or purchasing a J Marquel product, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or purchase our products.

1. WEBSITE USE

You agree to use this website only for lawful purposes.

You may not:

  • Attempt to gain unauthorized access to our website or systems;

  • Introduce viruses, malicious code, or harmful technology;

  • Interfere with website security or operation;

  • Use our website for fraudulent purposes;

  • Submit false or misleading information;

  • Scrape, reproduce, or commercially exploit our website content without authorization;

  • Infringe upon our intellectual-property rights; or

  • Engage in conduct that could harm J Marquel, its customers, employees, or business partners.

We reserve the right to refuse service, cancel orders, suspend accounts, or restrict access when we reasonably believe these Terms have been violated or fraudulent or abusive activity has occurred.

2. PRODUCTS

J Marquel watches are automatic mechanical timepieces.

Product specifications may include automatic movement, sapphire crystal, stainless-steel cases, genuine leather straps, interchangeable straps, and water-resistance ratings as described on the applicable product page.

Product photographs are intended to accurately represent our products, but slight differences may occur because of lighting, photography, display settings, natural leather variation, manufacturing processes, and product updates.

3. PRODUCT PRICING

All prices displayed on our website are in U.S. dollars unless otherwise stated.

Prices may change without notice.

We reserve the right to correct pricing, product, inventory, or website errors.

If an obvious pricing error occurs, we may cancel an affected order and refund amounts paid.

4. ORDERS AND PAYMENT

Submitting an order constitutes an offer to purchase.

An order confirmation does not necessarily mean that J Marquel has accepted the order if circumstances arise that require cancellation.

We may cancel an order because of:

  • Inventory limitations;

  • Payment problems;

  • Suspected fraud;

  • Incorrect pricing;

  • Incorrect customer information;

  • Shipping limitations; or

  • Other legitimate business reasons.

If we cancel an order after payment has been received, we will issue an appropriate refund.

5. ORDER CANCELLATION

Customers may request cancellation before an order has shipped.

Once an order has entered the fulfillment or shipping process, cancellation may no longer be possible.

Customers should contact J Marquel customer service as soon as possible if a cancellation is requested.

6. RETURNS AND REFUNDS

Unless otherwise stated for a specific product, J Marquel accepts eligible returns within 14 calendar days from confirmed delivery.

Returned watches must be:

  • Unworn;

  • Unused;

  • In substantially the same condition in which they were received;

  • Returned with original packaging and included accessories when reasonably possible; and

  • Accompanied by proof of purchase.

Customers must contact J Marquel before returning a product.

A return authorization may be required.

Products that show signs of wear, abuse, modification, damage, or misuse may not qualify for a refund.

Original shipping charges are generally non-refundable unless otherwise required by applicable law.

Approved refunds will be issued to the original payment method.

J Marquel will generally process an approved refund after the returned product has been received and inspected.

Financial institutions may require additional time before funds appear in the customer's account.

7. DAMAGED OR DEFECTIVE PRODUCTS

Customers should inspect their order promptly after delivery.

If a watch arrives damaged, defective, or materially different from the product ordered, contact J Marquel customer service as soon as reasonably possible.

We may request photographs, video, packaging information, tracking information, or other information necessary to investigate the claim.

If the issue is determined to be attributable to a manufacturing defect or fulfillment error, J Marquel may repair, replace, refund, or otherwise remedy the issue as appropriate and as permitted by applicable law.

Do not return a damaged or defective product without receiving return instructions.

8. SHIPPING

J Marquel currently advertises tracked and insured shipping. Delivery estimates may vary by destination and carrier.

Delivery dates are estimates and are not guaranteed unless expressly stated otherwise.

J Marquel is not responsible for carrier delays caused by circumstances beyond our reasonable control, including weather, natural disasters, customs delays, transportation interruptions, government actions, incorrect addresses, or other extraordinary events.

Customers are responsible for providing an accurate shipping address.

9. LOST OR STOLEN PACKAGES

If a package is lost or damaged during transit, J Marquel may assist with the applicable carrier claim.

Customers should retain tracking information and cooperate with reasonable carrier-investigation requirements.

Once a carrier confirms delivery to the address supplied by the customer, J Marquel may not be responsible for theft or loss occurring after confirmed delivery, except where otherwise required by applicable law.

10. TWO-YEAR LIMITED WARRANTY

J Marquel provides a two-year limited warranty beginning on the date the watch is delivered to the original purchaser.

The warranty covers qualifying manufacturing defects involving:

  • The automatic movement;

  • The sapphire crystal; and

  • Case seals.

The warranty applies to defects arising under normal and intended use.

J Marquel may, at its discretion and as permitted by law, repair the watch, replace components, replace the watch with a comparable product, or provide another appropriate remedy.

11. WARRANTY EXCLUSIONS

The limited warranty does not cover:

  • Accidental damage;

  • Drops or impacts;

  • Scratches;

  • Dents;

  • Normal cosmetic wear;

  • Strap wear;

  • Leather deterioration;

  • Misuse;

  • Abuse;

  • Neglect;

  • Unauthorized modifications;

  • Unauthorized repairs;

  • Damage caused by chemicals or corrosive substances;

  • Water damage resulting from use beyond the stated water-resistance rating;

  • Damage caused by failure to properly operate or secure the watch;

  • Loss or theft; or

  • Damage caused by third-party modifications or accessories.

The warranty does not guarantee that a watch will remain free from ordinary cosmetic wear throughout its useful life.

12. WATER RESISTANCE

Water resistance is not permanent and may decrease over time due to wear, aging, impact, or deterioration of seals.

Customers should follow the water-resistance rating and care instructions applicable to their specific watch.

Water damage resulting from misuse, impact, improper operation, or exposure beyond the stated rating may not be covered.

13. AUTOMATIC MOVEMENT

J Marquel watches use automatic mechanical movements.

Automatic watches require movement or winding to maintain operation and may stop after remaining stationary for an extended period.

Mechanical movements may have reasonable variations in timekeeping.

Such normal characteristics do not necessarily constitute manufacturing defects.

14. STRAPS

J Marquel offers interchangeable straps, including genuine leather straps.

Natural leather may vary in grain, texture, color, markings, and finish.

These characteristics are natural and are not necessarily defects.

Straps experience normal wear and may require replacement over time.

15. INTELLECTUAL PROPERTY

All J Marquel trademarks, logos, names, watch designs, product photographs, graphics, written content, videos, website designs, slogans, product descriptions, and other original materials are owned by, licensed to, or lawfully used by J Marquel.

You may not reproduce, distribute, modify, publish, sell, license, or commercially exploit J Marquel intellectual property without prior written authorization.

16. CUSTOMER REVIEWS AND TESTIMONIALS

By voluntarily submitting a review, testimonial, photograph, video, or other content to J Marquel, you represent that you have the right to submit that content.

Subject to applicable law, you grant J Marquel a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, and use that content for legitimate business, marketing, advertising, and promotional purposes.

17. THIRD-PARTY SERVICES

Our website may use third-party providers for payment processing, shipping, analytics, marketing, advertising, website functionality, and other services.

Third-party services are subject to their own terms and policies.

J Marquel is not responsible for third-party websites or services outside our reasonable control.

18. DISCLAIMER

To the fullest extent permitted by law, J Marquel does not guarantee that the website will always be uninterrupted, error-free, or completely secure.

Nothing in these Terms excludes any consumer right, warranty, or protection that cannot legally be excluded.

19. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, J Marquel Watch Company and its owners, officers, directors, employees, agents, affiliates, contractors, suppliers, and service providers shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, or anticipated savings.

To the fullest extent permitted by applicable law, J Marquel's total aggregate liability arising from or relating to any product, service, transaction, agreement, claim, or dispute shall not exceed the total amount actually paid by the customer to J Marquel for the specific product or service giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the claim.

If a claim does not relate to a specific product or service, J Marquel's maximum aggregate liability shall not exceed the total amount actually paid by the customer to J Marquel during the twelve (12) months preceding the event giving rise to the claim.

Nothing in this section limits or excludes liability that cannot legally be limited or excluded.

20. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless J Marquel and its owners, officers, directors, employees, agents, affiliates, contractors, and service providers from claims, damages, losses, liabilities, costs, and reasonable attorneys' fees arising from your violation of these Terms, misuse of our website or products, violation of law, infringement of third-party rights, or intentional or negligent conduct.

21. DISPUTE RESOLUTION

Customers are encouraged to contact J Marquel first so that we may attempt to resolve disputes informally.

Before initiating formal legal proceedings, the customer should provide written notice describing the dispute and requested resolution.

Nothing in these Terms prevents a consumer from exercising rights that cannot legally be waived.

22. GOVERNING LAW

These Terms shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except to the extent mandatory federal or consumer-protection laws apply.

To the extent permitted by applicable law, disputes that cannot be resolved informally shall be brought in a court of competent jurisdiction in Georgia.

23. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, it shall be modified to the minimum extent necessary or severed if modification is not legally permitted.

The remaining provisions shall remain effective.

24. CHANGES TO THESE TERMS

J Marquel may update these Terms from time to time.

Updated Terms will be posted on our website with a revised effective date.
